Terms of Use

The agreement between you and Sip Stack.

These Terms of Use (the “Terms”) are a legal agreement between you and Sip Stack (“Sip Stack,” “we,” “us,” or “our”) governing your use of the Sip Stack application and related services (the “App”). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

Sip Stack is intended for adults of legal drinking age in their jurisdiction. By using the App, you represent that you are of legal drinking age where you live and that you will use the App in a lawful and responsible manner. The App is informational and is not intended to encourage excessive or irresponsible consumption of alcohol.

2. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App, except to the extent that restriction is prohibited by law.

3. Sip Stack Pro subscription

The App offers an optional auto-renewable subscription, “Sip Stack Pro,” which unlocks features such as unlimited label scans, your full taste profile, personalized recommendations, dislike intelligence, and wishlists.

Price. Sip Stack Pro is offered at $4.99 per month or $39.99 per year. A 7-day free trial may be offered to new subscribers. Prices may vary by region and are shown in the App before purchase. [Confirm current pricing/trial in App Store Connect.]
Payment. Payment is charged to your Apple Account at confirmation of purchase.
Auto-renewal. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period at the then-current price.
Free trial. If you take a free trial and do not cancel at least 24 hours before it ends, it converts to a paid subscription at the applicable price. Any unused portion of a free trial is forfeited if you purchase a subscription.
Managing and cancelling. You can manage or cancel your subscription, or turn off auto-renewal, in your Apple Account settings (Settings → your name → Subscriptions) after purchase. Deleting the App does not cancel your subscription.
Refunds. Purchases are handled by Apple; refund requests are subject to Apple’s policies.

4. AI-generated content and accuracy

Sip Stack uses artificial intelligence (including image recognition) to identify wines and generate descriptions, pairings, and recommendations. This information is provided for general, informational purposes only and may be incomplete or inaccurate. It is not professional, medical, dietary, or purchasing advice. Always verify details such as producer, vintage, allergens, and price independently before relying on them. You are responsible for your own decisions.

5. Acceptable use

You agree not to misuse the App, including by attempting to interfere with, overload, or gain unauthorized access to our servers or systems; bypassing usage limits or authentication; uploading unlawful content; or using the App to violate any law. We may suspend or terminate access for conduct that we reasonably believe violates these Terms or harms the service or others.

6. Intellectual property

The App, including its design, text, graphics, and software, is owned by Sip Stack and protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or content except the limited license described above. Your journal content remains yours.

7. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that any information it provides is accurate.

8. Limitation of liability

To the maximum extent permitted by law, Sip Stack and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of the App. To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the twelve months before the claim.

9. Termination

You may stop using the App at any time and delete your account from within the App. We may suspend or terminate your access if you violate these Terms. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date and, where appropriate, notify you in the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, except where local consumer-protection law requires otherwise. [Adjust if you incorporate elsewhere.]

12. Apple App Store terms

The following terms apply because you obtained the App from the Apple App Store:

These Terms are between you and Sip Stack only, and not with Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide any maintenance or support for the App. Any maintenance and support is provided by Sip Stack.
In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are the responsibility of Sip Stack.
Sip Stack, not Apple, is responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer-protection or similar legislation.
In the event of any third-party claim that the App or your use of it infringes that party’s intellectual-property rights, Sip Stack, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting,” and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you as a third-party beneficiary.
You must also comply with applicable third-party terms of agreement when using the App.
